Terms &
Conditions
Welcome to KridSpot. These Terms and Conditions govern your access to and use of the KridSpot website, software platform, auction system and related services available at kridspot.com. By creating an account, accessing the Platform, purchasing a paid service, activating an auction, or using KridSpot in any way, you agree to these Terms. If you do not agree, please do not use the Platform.
KridSpot is a sports technology platform that provides software tools for organising and managing sports-related activities.
At the current stage, KridSpot primarily provides a digital sports auction management system that enables organisers to create and conduct team auctions using a virtual auction purse.
Additional features — including tournament management, match information, scoring, historical auction records and other sports-management services — may be introduced over time.
Users may create or use KridSpot accounts according to the roles and permissions made available by the Platform. Users may include organisers, administrators, team representatives, players, scorers, participants and other authorised users.
You agree to:
- provide accurate and current information
- maintain the confidentiality of your account credentials
- not share credentials in a way that compromises Platform security
- promptly inform KridSpot if you suspect unauthorised access to your account
- remain responsible for activities carried out through your account where permitted by law
Users under 18
Where a user is under 18 years of age, use of the Platform must take place with the involvement, consent or supervision of a parent, lawful guardian or appropriately authorised organiser where required by applicable law. KridSpot may require additional verification, restrict account functionality or prevent account creation until such requirements are satisfied.
KridSpot provides technology that assists organisers in conducting sports team auctions. Words used within the Platform such as "auction", "bid", "sold", "price", "highest bid", "base price" and "purse" refer only to the mechanics of the sports team-selection process.
Virtual purse
A bid or "sale" of a player does not constitute the purchase or sale of a person, does not create ownership over a player, does not automatically create an employment relationship, does not represent money payable by KridSpot to the player, and does not create any financial claim against KridSpot. The auction functionality is intended solely for sports team selection and event-management purposes.
KridSpot's current auction system does not provide real-money betting, wagering or gambling functionality. Users must not use KridSpot to conduct, facilitate, advertise or support unlawful gambling, wagering, betting or real-money gaming activities. KridSpot may suspend or terminate accounts where it reasonably believes the Platform is being misused for such purposes.
An organiser remains responsible for the auction or sporting event conducted using KridSpot. KridSpot provides the technology platform and does not automatically become the organiser, promoter, team owner, selector or governing body of an event.
The organiser is responsible for:
- creating accurate auction information and selecting participating teams and players
- establishing auction rules, virtual purses and base values
- operating the auction appropriately and resolving event-specific disputes
- verifying eligibility of participants and obtaining necessary consents
- ensuring information uploaded to KridSpot is lawful and accurate
- obtaining permission to use player photographs, videos and other materials
- sponsor arrangements, prizes and awards promised to participants
- compliance with rules applicable to the organiser's event
Where an organiser, administrator or authorised user provides information relating to another person, that user represents that they have the lawful authority, permission or other valid basis necessary to provide such information to KridSpot. Users must not upload information they have no lawful right to provide.
Where enabled, organisers may upload photographs, videos, logos, sponsor materials and other event-related media. The person uploading such material represents that:
- they own the material or have sufficient permission to use it
- the upload does not violate another person's privacy, intellectual-property or other legal rights
- appropriate participant permissions have been obtained where required
By uploading event media, the uploader grants KridSpot a non-exclusive, royalty-free licence to store, reproduce, resize, format, display and process that material as reasonably necessary to provide Platform features. If you believe an image or video has been uploaded without appropriate authority, contact kridspot@gmail.com.
Organisers may upload sponsor names, logos, advertisements or promotional materials where the Platform provides that functionality. The organiser is responsible for having permission to display the sponsor's intellectual property, ensuring sponsor material is lawful, and managing their commercial relationship with the sponsor. Displaying sponsor material on KridSpot does not mean KridSpot endorses or has a commercial relationship with that sponsor.
KridSpot may provide a free Trial or Demo Mode. Trial Mode is provided without charge, may use demo data, is intended to allow organisers to test Platform functionality, may contain restrictions compared with paid or Live Mode functionality, and may be changed, limited or discontinued by KridSpot. Trial Mode does not create an entitlement to any specific future feature.
An organiser may activate an auction into "Live Mode" to indicate that the auction configuration is intended for a real event. Before activating Live Mode, the organiser is responsible for reviewing all relevant auction information and configuration. Certain settings may become restricted from editing after Live Mode is activated to preserve auction integrity. Activation of Live Mode may also affect cancellation and refund eligibility as described in the Cancellation & Refund Policy.
KridSpot may charge organisers for use of paid Platform functionality. At the current stage, charges may be calculated according to the number of teams registered or enabled for an auction. The actual amount payable will be communicated to the organiser before purchase through a quotation, invoice, email or other written communication. Fees and pricing structures may change for future purchases. A pricing change will not retrospectively alter fees already agreed for a completed purchase.
KridSpot currently does not operate an integrated online payment gateway. Payments for paid services may be arranged directly between KridSpot and the organiser using payment instructions communicated by KridSpot. KridSpot may maintain invoices, payment confirmations, transaction references and accounting records required to administer the service. If payment gateways or additional payment methods are introduced later, these Terms and related policies may be updated accordingly.
Payments are subject to the KridSpot Cancellation & Refund Policy. Except where that policy or applicable law provides otherwise, fees paid for KridSpot digital services are non-refundable. Activating Live Mode generally indicates that the purchased auction service has begun to be consumed. This does not limit any refund or remedy that must be provided under applicable law or where a material failure of KridSpot's Platform makes the purchased service unusable.
KridSpot aims to provide reliable Platform access but does not guarantee uninterrupted or error-free operation. Availability may be affected by maintenance, upgrades, internet connectivity, hosting or infrastructure problems, third-party provider outages, cyberattacks, device or browser problems, telecommunications failures, force majeure events or circumstances outside KridSpot's reasonable control. Where a material technical failure attributable to KridSpot prevents delivery of a paid auction service, the organiser may be eligible for a remedy under the Cancellation & Refund Policy.
Users are responsible for maintaining appropriate internet connectivity, compatible devices, supported browsers, electricity or power arrangements, and local event infrastructure. KridSpot is not responsible for an auction failure caused solely by an organiser's device, local network, internet provider, power failure or other infrastructure outside KridSpot's reasonable control.
Users must not:
- attempt to gain unauthorised access to KridSpot systems or bypass Platform security
- introduce malware or harmful code or interfere with Platform operation
- deliberately manipulate Platform records or create fraudulent registrations
- impersonate another person
- scrape or extract Platform data using unauthorised automated means
- reverse engineer KridSpot software except where such a restriction is prohibited by applicable law
- copy or commercially exploit KridSpot software without permission
- use the Platform for unlawful purposes, including unlawful gambling or betting
- upload unlawful or infringing material
- attempt to compromise another user's account or abuse Platform functionality
Completed auction and event information may form part of the historical record of an event. If a user later deletes their account, KridSpot may retain limited historical records reasonably necessary to preserve the integrity of completed auctions, team records, match records, results or statistics. Where reasonably practicable, personal account or contact information that is no longer necessary will be deleted or separated from historical records. Account deletion therefore may not require deletion of every historical sporting fact or event record associated with the person.
The KridSpot Platform — including its software, source code, design, user interface, databases, branding, logos, original graphics, Platform structure, templates and other proprietary materials — is owned by or licensed to the operator of KridSpot. Users receive only a limited, non-exclusive and revocable right to use the Platform in accordance with these Terms. Nothing in these Terms transfers ownership of KridSpot's intellectual property to a user. Organisers and users retain their rights in content that they lawfully own and upload, subject to licences reasonably necessary for KridSpot to provide and promote the Service.
If users voluntarily provide suggestions, ideas or product feedback, KridSpot may use that feedback to improve its products and services without an obligation to compensate the person providing it. This does not transfer ownership of unrelated user content to KridSpot.
KridSpot may communicate with users through email, mobile notifications, SMS, WhatsApp or other contact methods where available and lawfully permitted. Service-related communications may include login or security messages, account notifications, auction notifications, operational updates, important policy notices and support communications. Marketing communications may be sent where permitted by applicable law. Users may opt out of marketing communications through the method provided in the message or by contacting KridSpot. Opting out of marketing does not prevent essential service or security communications.
KridSpot may rely on third-party infrastructure or service providers to operate the Platform, including services for networking, security, email, hosting and communications. The failure of an independent third-party service does not automatically constitute negligence by KridSpot. However, this provision does not remove any statutory obligation KridSpot may have toward a consumer.
KridSpot may restrict, suspend or terminate access where reasonably necessary because of a material violation of these Terms, fraud or suspected fraud, security threats, abuse of the Platform, attempted unauthorised access, unlawful activity, non-payment of agreed charges, intentional manipulation of auction information, or conduct that materially threatens other users or the Platform. Where appropriate and reasonably possible, KridSpot may provide an opportunity to correct the issue before taking action.
KridSpot is a technology provider. KridSpot does not guarantee the eligibility of a player for an event, the accuracy of participant information supplied by an organiser, the outcome of an auction, the quality or performance of a player or team, organiser or selection decisions, prizes promised by an organiser, sponsor commitments, accuracy of user-entered statistics, or resolution of disputes between organisers, players or teams. Organisers remain responsible for the operation of their events.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. To the maximum extent permitted by applicable law, KridSpot will not be liable for indirect, incidental, special or consequential loss resulting from use of the Platform, including loss arising solely from circumstances outside KridSpot's reasonable control.
To the extent permitted by law, an organiser agrees to be responsible for claims arising from material they upload, event information they provide, their unlawful use of the Platform or their violation of third-party rights. KridSpot will not seek indemnification for losses caused by KridSpot's own unlawful conduct where such allocation would be prohibited by law.
KridSpot's collection and use of personal data is governed by the KridSpot Privacy Policy. Users should review the Privacy Policy before providing personal information.
KridSpot may modify, improve, replace or discontinue Platform functionality as the product evolves. Where a material change affects a paid service already purchased, KridSpot will handle the situation consistently with the agreed service terms and applicable law.
These Terms may be updated to reflect new Platform features, changes in business operations, legal or security requirements, or changes to our services. The updated version will show a revised effective date. Where required by law or where a change materially affects existing users, KridSpot may provide additional notice.
These Terms are governed by the laws of India. Users and KridSpot should first attempt to resolve disputes in good faith through the support or grievance process. Subject to rights or jurisdictions that cannot be excluded under applicable consumer or other law, courts having jurisdiction in Jalgaon, Maharashtra, India will have jurisdiction over disputes relating to these Terms and the Platform.
These Terms, together with the Privacy Policy, Cancellation & Refund Policy and any written commercial terms agreed with an organiser, constitute the agreement governing use of the relevant KridSpot services. Where specific written commercial terms agreed for an organiser conflict with these general Terms, the specific commercial terms will apply to that transaction to the extent of the conflict, except where prohibited by law.
